Revenue was from the Ampligen cost-recovery program, not material product sales. No meaningful operating margin is reported; revenue remained very small relative to operating expenses.
- At June 30, cash and cash equivalents were $21.038 million and marketable securities were $7.360 million, totaling $28.398 million, down about $5.792 million from year-end 2022.
- Six-month operating cash use was $5.838 million, versus $5.071 million in 2022. Investing activities used $0.282 million, compared with $7.375 million provided in 2022; financing provided $0.105 million.
- Current assets were $28.869 million and current liabilities $2.885 million. Total assets were $33.617 million; stockholders’ equity was $30.135 million.
- The balance sheet shows no borrowings; operating lease liabilities totaled $0.803 million, including $0.206 million current. This is not a statement that the company has no other commitments.
- Common shares outstanding were 48.419 million at June 30 and 48.670 million as of August 11. The company sold shares through employee plans and an at-the-market equity distribution agreement (EDA); further EDA sales after quarter-end are disclosed below.
Material changes and unusual items
- Six-month net loss narrowed slightly year over year, despite higher operating loss, as investment results improved and interest income and gains from selling tax operating losses increased. Q2 net loss increased 1% year over year.
- Six-month R&D expense rose $1.494 million, principally from higher manufacturing costs; G&A rose $0.588 million, mainly from professional fees. Management attributed the increase in Q2 R&D largely to manufacturing costs, partly offset by lower clinical-trial expense.
- Investment results shifted to a $0.109 million gain for the first half of 2023 from a $1.404 million loss in 2022. Interest and other income rose to $0.517 million from $0.124 million.
- The company recognized a $0.582 million first-half gain from sale of income-tax operating losses, including a deferred tax asset related to New Jersey net operating losses expected to be sold in 2024.
- There were no production costs in the first half of 2023, compared with $0.147 million in 2022, following the sale of the manufacturing facility and the absence of production during the period.
Outlook, programs and risks
- Management said existing resources were expected to fund anticipated operating needs and current clinical trials for approximately 24 months, based on the company’s current financial condition. AIM has minimal operating revenue, does not expect material revenue in the near future, and may require additional financing. It cautioned that financing may be unavailable or dilutive.
- The EDA permits up to $8.5 million of common-stock sales. Through June 30, AIM sold 11,937 shares for gross proceeds of $5,593; after quarter-end, it sold 234,386 shares for gross proceeds of $152,579. The agent’s fee is 3% of gross sales.
- The Phase 2 AMP-270 randomized pancreatic-cancer trial was recruiting. Its estimated duration is approximately 4.6 years and Amarex’s estimated management cost is about $8.2 million, excluding certain additional costs. A separate Erasmus MC/AstraZeneca pancreatic-cancer study received required Dutch approvals in June.
- The Phase 2 AMP-518 post-COVID study had reached planned enrollment of 80 and subjects were being dosed as of August 14, 2023. This update is subsequent to the reporting date.
- Ampligen’s U.S. ME/CFS application received an FDA Complete Response Letter in 2013; management said it is preparing responses and a proposed confirmatory-trial plan. Argentine commercial sales remain subject to final inspection and product-release testing, which management said had been delayed.
- New Alferon N Injection production is on hold, with no definitive restart timetable. Resumption would require a manufacturing approach and FDA acceptance of relevant quality and stability data.
- Key risks include clinical efficacy and safety uncertainty, regulatory approval and manufacturing requirements, dependence on contract manufacturers and vendors, and the need for additional capital or commercial partners. Several oncology and antiviral programs are investigator-sponsored, suspended, or dependent on further approvals or available study drug.
- Legal matters remain unresolved, including litigation involving BioLife Plasma Services and disputes involving Jorgl and Tudor-related actions. The filing does not quantify any expected recovery or liability. A stockholder also submitted notice of intent to nominate directors for the 2023 annual meeting.
